Megan's Law - Exclusion from Megan's Law Website California Penal Code 290.46

In 2004, the California Legislature amended "Megan's Law" (Penal Code Section 290.46) requiring the Department of Justice to maintain an Internet website: www.meganslaw.ca.gov.  If you are required to register as a sex offender, your picture, home address, conviction(s) and other identifying information may be posted on the Megan’s Law website for the public to access. Unless you qualify for exclusion, your information can be displayed.

Exclusion from the Megan’s Law Website

There are some circumstances in which you may be excluded from public notification on the Megan’s Law website. You may apply with the Department of Justice for exclusion from the website if you committed the following offenses:

Do you wish to have your name and personal information removed from the Megan's Law Website?

  • A felony violation of sexual battery – PC 243.4;
  • A misdemeanor violation of enticing a minor for prostitution of sexual intercourse – PC 266;
  • A felony violation for distributing, possessing, or making child pornography if you submit to the department a certified copy of a probation report filed in court that clearly states that all victims involved in the commission of the offense were at least 16 years of age or older at the time of the commission of the offense – PC 311.1, 311.2, 311.3, 311.4, 311.10, or 311.11;
  • An offense for which you successfully completed probation, provided that you submit to the department a certified copy of a probation report, presentencing report, report prepared pursuant to Section 288.1, or other official court document that clearly demonstrates that you were the victim’s parent, stepparent, sibling, or grandparent and that the crime did not involve either oral copulation or penetration of the vagina or rectum of either the victim or the offender by the penis of the other or by any foreign object; or
  • An offense for which the offender is on probation at the time of his or her application, provided that the offender submits to the department a certified copy of a probation report, presentencing report, report prepared pursuant to Section 288.1, or other official court document that clearly demonstrates that the offender was the victim’s parent, stepparent, sibling, or grandparent and that the crime did not involve either oral copulation or penetration of the vagina or rectum of either the victim or the offender by the penis of the other or by any foreign object.

Consequences of Violation of Probation, Parole, or Community Supervision

If you commit a violation of probation, parole, or community supervision resulting in incarceration in county jail or state prison after you apply for an exclusion from the Megan’s Law website, your exclusion or application for exclusion from the Megan’s Law website shall be terminated. It is important to know that being excluded from the Megan’s Law website does not terminate your duties to register as a sex offender under Penal Code Section 290. It is also important for you to understand that in addition to the state's official Megan's Law website, there are many other privately-operated, public criminal offender websites that may display your information, often incorrectly. Currently, there is no government regulation of these privately operated (for profit) criminal databases.
