OJ Simpson Conviction For Robbery And Kidnapping Upheld On Appeal

On October 22, 2010 the Nevada Supreme court denied OJ Simpson’s appeal to overturn his armed robbery and kidnapping convictions. Simpson was convicted by a Las Vegas jury for a crime in a hotel which he claims he was trying to reclaim property that belonged to him. Simpson is currently serving a felony sentence of 33 years in a state prison with a possibility of parole after nine years.

Simpson’s appellate lawyers were arguing that there were multiple errors committed during the former football stars trial which violated his rights to a fair trial and due process.  Simpson’s lawyers claim there was a possible prejudice among jurors due to Simpson’s previous murder allegations of ex-wife Nicole and a male friend.

However, the Nevada Supreme Court has rejected these claims, stating that Simpson’s lawyers did not object to the rulings they claim are prejudicial at the time of trial.  The panel also rejected the challenges to both the robbery and kidnapping convictions. The Supreme Court held that the fact that Simpson used a false pretense of luring the victims to a hotel to purchase memorabilia is sufficient for the kidnapping charge.

Robbery is the felonious taking of personal property in the possession of another, from his person or immediate presence, and against his will, accomplished by means of force or fear. (P.C. §211.) Kidnapping is defined as every person who forcibly, or by any other means of instilling fear, steals or takes, or holds, detains, or arrests any person in this state, and carries the person into another country, state, or county, or into another part of the same county, is guilty of kidnapping. (P.C. §207.)
