Can I go to Jail if I Refuse to Testify in a Spousal Battery or Domestic Violence Case in Irvine?

Every day, thousands of people are arrested for spousal battery in California. In the majority of those cases, the alleged “victim” does not want their attacker to be prosecuted or face jail time. The good news is that the answer is no. California Code of Civil Procedure Section 1219 states:

“Notwithstanding any other law, no court may imprison or otherwise confine or place in custody the victim of a sexual assault or domestic violence crime for contempt when the contempt consists of refusing to testify concerning that sexual assault or domestic violence crime.”
