How to Defend a Felony Case, Part 1: Pre-Filing

The first step in defending a felony charge begins before charges have even been filed. We call this the pre-filing stage. During the pre-filing stage, an attorney can contact law enforcement officers to learn what evidence they have against the client. While police officers have no obligation to speak with criminal defense attorneys, we are frequently able to convince detectives to divulge their whole case to us. This helps us know what strategy to use when defending you.

We also try to convince law enforcement officers not to arrest our clients, or to do so in a more convenient way. For example, instead of having the police arrest a client at work or in front of the client’s children (which would be embarrassing and traumatic), we can frequently arrange for the client to report to law enforcement to be booked with a bail bondsman present. This means that the client will only spend a few hours in custody, as opposed to a few days or longer.
