In response to the overcrowding of city and county jails, California recently changed California Penal Code section 4024.1, which allows you to be released from custody prior to your scheduled release date. California Penal Code section 4024.1 now provides that the court may authorize your early release up to 30 days prior to the date originally scheduled for your release. Prior to the change in the law you could only be released up to 5 days early.
In order for you to be eligible for early release the sheriff, chief of police, or another person responsible for the county or city jail must apply to the Superior Court. The closer your release date the easier the process will likely be because inmates that are closest to the normal release date are given priority. Once the court approves of your early release you will be released from custody.
The change in the law allows you to be reunited with your family and friends much sooner than the original sentence permitted and can have a positive impact on your life.
