What happens if I post bail, but fail to appear on the scheduled court date?
If you fail to appear on the scheduled court date, the judge may forfeit your bail and issue a bench warrant for your arrest. If you used a bail bondsman and the court forfeits your bail the bail bondsman will likely do all in his power to locate you and arrest you. If he fails to bring you to court within 180 days of when the court issues the warrant for your arrest for failure to appear he will be required to pay the court the full amount of the bail bond.
This is why bondsmen often hire “bounty hunters” to locate those that fail to appear in court. You do not want this to happen to you.
What factors will the judge consider in deciding whether or not I should be taken into custody if I am arrested on a warrant?
A judge has the option to either release you on your own recognizance, or take you into custody depending on several factors, including: your criminal history, the reason(s) for which the warrant was issued and whether or not you are likely to flee to avoid prosecution (flight risk).
If I have a warrant out for my arrest, can I fight it before I am arrested?
Yes. It is highly recommended that you voluntarily appear at court with an attorney to clear your bench warrant before you get “picked up” by the police.
Can the court issue a bench warrant for my arrest if I fail to pay child support or spousal support?
Yes. A bench warrant may be issued if you fail to obey a court order, including failure to pay child support or spousal support.
Can the court issue a bench warrant for my arrest if I fail to appear on a jury summons?
Yes. Failure to report for jury duty qualifies as contempt of court. If you fail to make a court appearance, even if it is for jury duty, the judge may issue a bench warrant for your arrest.
